Abstract

In an ever-changing environment that is the art world, collectors and dealers must stay up to date on how to protect their art objects. With the global landscape of the growing art market, there are more and more risks inherent to art. Of these risks, title disputes are becoming increasingly problematic with works that seemingly did not have issues. This will be demonstrated by the case DAE Associates d/b/a Danese Gallery v. AXA Art Insurance, which involves a stolen Jasper Johns work, a dealer caught in a binding contract, and a dispute over the wording of an AXA policy. In order to avoid situations such as this, collectors must protect their art. Art title insurance is a form of risk mitigation that gives art world professionals the reassurance that is desired in such an opaque market.
